Rift.TCG is an iOS and Android Application based on the Riftbound trading card game. The Application allows you to access a list of the various cards published and to manage your collection. The following Terms of Use applies to the use of the Rift.TCG iOS and Android Application available on the App Store and Google Play Store. By using the Application, the User agrees to the following conditions:

1. Service

1.1 Rift.TCG allows you to access a list of the different cards and series available and to manage your collection.

1.2 The User can create a Rift.TCG account with Google or Apple Sign-in. Find the Privacy Policy of the Rift.TCG Application on this link: https://rifttcg.app/privacy.html. The use of a Rift.TCG account allows you to save your collection on the Rift.TCG servers if you use it on several platforms.

2. Rift.TCG PLUS

2.1 The User has the possibility to improve his/her user experience by purchasing the "Rift.TCG PLUS" option available on the Application, allowing him/her to access the following advantages:

• View an estimate of your entire collection from the statistics screen, updated regularly
• View all card and sealed item price information: trend, average, minimum, average per day/week/month
• Create unlimited favorite lists

This purchase consists of a monthly payment with automatic renewal, an annual payment with a substantial discount, or a one-time Lifetime payment.

2.2 Payment is linked to the user's account. This means they can also use their options on another platform.

2.3 The "Lifetime" plan grants access to the Rift.TCG PLUS features for the entire duration of commercial operation of the Service by Lops TCG. The term "Lifetime" does not refer to the biological lifetime of the user but to the lifetime of the Service. If Lops TCG permanently discontinues the Service (see section 19), the Lifetime plan ends without entitlement to any refund, subject to the notice and data export conditions set out in section 19.

3. Payment

3.1 All payments are managed by Apple on iOS and Google on Android and RevenueCat as our third party partner.

3.2 Prices of Memberships depend on the User's country of residence and may change from time to time. The price displayed on the App at the time of subscription, along with any required taxes if applicable, will be honoured. The payment must be made in advance of a Membership.

3.3 Features described in 2.1 will be accessible as soon as the payment has been invoiced and confirmed by Apple or Google, on the payment method selected by the User. There may be a delay between the finalisation of the payment process on the Application and the availability of the features.

3.4 If you subscribe to any Rift.TCG PLUS plan, payment will be charged to your iTunes or Google account and your account will be charged for renewal within 24-hours prior to the end of the current period. You can choose to be billed monthly or yearly. You can turn off auto-renew in your Apple ID Account Settings or in your Google Account any time after purchase.

4. Right of withdrawal

4.1 In accordance with Apple's policy, your refund rights vary depending on the type of product. See the refund terms provided by App Store on this page: https://support.apple.com/en-us/118223. In any case, we invite you to use the means of refunds provided by the App Store in the first instance.

4.2 In accordance with Google's policy, your refund rights vary depending on the type of product. See the refund terms provided by Google Play on this page: https://support.google.com/googleplay/answer/2479637. In any case, we invite you to use the means of refunds provided by Google in the first instance.

4.3 In accordance with article L. 221-28 13° of the French Consumer Code, the User expressly acknowledges and accepts that the Rift.TCG PLUS subscription, as digital content supplied immediately upon payment, is excluded from the 14-day right of withdrawal. By subscribing, the User expressly requests immediate provision of the Service and waives their right of withdrawal.

6. Accuracy of information

6.1 We make everything possible to provide the most up-to-date database possible, however Rift.TCG cannot guarantee that information in the App is always fully accurate, complete or current. 6.2 Prices displayed for cards and sealed products are provided for informational purposes through third-party partners. Rift.TCG does not guarantee the real-time accuracy of this data.

7. Disclaimer

7.1 Rift.TCG is not an official Riftbound application, it is not affiliated, endorsed or supported by Riot Games, Inc. Images and illustrations used are the property of their respective authors.

8. Intellectual property rights

8.1 Rift.TCG is the holder of all intellectual property rights on information provided by the App, such as patents, patent applications, trademarks, trademark applications, service marks, trade names, copyrights, trade secrets, licenses, domain names, know how, property rights and processes (Intellectual Property Rights).

8.2 Rift.TCG gives you a personal, non-exclusive and non-transferable licence to use the Website and the App. The User is not allowed to sell, sub-license, distribute or access in any other way (i.e. via screen-scraping or url-guessing) the content of the Website and the App.

8.3 The User is not allowed to reverse engineer, decompile or otherwise attempt to derive the source code, techniques, processes, algorithms or other know-how from Rift.TCG.

8.4 The App, Website and all other content is solely intended for your personal, non-commercial use. Any other use of the App requires the prior written permission of Rift.TCG.

9. Miscellaneous

9.1 Rift.TCG reserves the right to alter these Terms. When we change these Terms in a significant way, we will post a notification on our Website along with the updated Terms. We will also notify you via our App, and request you to accept the updated Terms before you can continue your use of our App. By continuing to use the App, Website and/or our services you acknowledge the most recent version of these Terms.

10. Applicable law and jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of France.

10.2 All disputes resulting from or arising in connection with these Terms shall be exclusively submitted to the competent court of Paris, France, unless the dispute can be settled in an amicable fashion.

13. Use of Cookies

The Rift.TCG application uses Firebase Analytics and Crashlytics for statistical and performance purposes (anonymized). The rifttcg.app website does not use analytics or advertising cookies. For more information, please consult our Privacy Policy.

14. Account Deletion

Users may delete their Rift.TCG account and all related saved data directly from the application settings. Alternatively, a deletion request can be sent by email to lopspower@gmail.com. Deletion requests will be processed within 30 days.

15. User Obligations and Account Suspension

15.1 The User undertakes to use the Service in good faith and in compliance with applicable laws and these Terms. In particular, the User shall not:

• create multiple accounts to bypass any limit, free trial or promotion;
• share, lend, resell or otherwise transfer their account or Rift.TCG PLUS subscription to a third party;
• extract, scrape, copy or reuse the content of the Service (cards database, prices, decks) for commercial purposes or to develop a competing service;
• circumvent the technical protection measures of the Service;
• upload illegal, abusive, defamatory or infringing content.

15.2 In case of breach of these obligations, of fraud, of payment incident, or of any abuse, Lops TCG reserves the right to suspend or terminate the User's account, without prior notice and without any refund obligation.

16. Minors and Parental Consent

16.1 The Service is not intended for users under 15 years of age (in France) or under the digital majority age applicable in their country of residence. Minors below that age may only use the Service with prior consent of a parent or legal guardian.

16.2 Parents or legal guardians are fully responsible for the use of the Service by minors under their authority, including any in-app purchase or subscription made from a device they control. We recommend enabling the parental control features provided by Apple ("Screen Time") and Google ("Family Link").

17. Limitation of Liability

17.1 The Service is provided "as is" and "as available". Lops TCG makes no warranty that the Service will be uninterrupted, error-free, or fully compatible with all devices.

17.2 To the maximum extent permitted by applicable law, Lops TCG's total aggregate liability towards a User, all causes combined, shall not exceed the total amounts effectively paid by that User to Lops TCG for the Rift.TCG PLUS subscription during the twelve (12) months preceding the event giving rise to the claim.

17.3 Lops TCG shall not be liable for any indirect, incidental, consequential or punitive damages, including loss of profit, loss of data, loss of opportunity, or any damage resulting from third-party services (Apple, Google, RevenueCat, Firebase, etc.).

17.4 Nothing in these Terms shall exclude or limit Lops TCG's liability for gross negligence, willful misconduct, or any liability which cannot be excluded or limited under French law.

18. Force Majeure

18.1 Lops TCG shall not be held liable for any failure or delay in the performance of its obligations under these Terms resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code, including but not limited to: natural disasters, fires, floods, epidemics, pandemics, governmental decisions, wars, acts of terrorism, strikes, telecommunications outages, hosting provider failures (e.g. OVH, Google, Apple), generalized internet outages, or cyber-attacks.

18.2 If the force majeure event continues for more than ninety (90) consecutive days, either party may terminate the agreement without compensation.

19. Service Discontinuation

19.1 Lops TCG reserves the right to permanently discontinue the Rift.TCG Service at any time, in particular in case of cessation of activity of the company, of economic non-viability, or of major technical impossibility.

19.2 In such a case, Lops TCG undertakes to give Users a prior notice of at least ninety (90) days, communicated through the Application and/or by email.

19.3 During this notice period, Users will be able to export their collection and saved data in a usable format (e.g. CSV or JSON), via a feature provided in the Application or upon request at lopspower@gmail.com.

19.4 Active monthly and annual subscriptions will not renew during the notice period. No prorated refund will be due for subscription periods already started, except where required by applicable law.

19.5 Lifetime plans will end upon the effective discontinuation of the Service, without entitlement to any refund, in accordance with section 2.3.

19.6 At the end of the notice period, all personal data will be deleted in accordance with the Privacy Policy, except for data that must be kept to comply with legal obligations (e.g. accounting).

20. Price Data and Third-Party Sources

20.1 Rift.TCG aggregates and displays card price information ("Price Data") obtained from third-party sources such as Cardmarket, TCGPlayer, eBay, PSA and other market data providers. These Price Data are provided for informational purposes only and do not constitute, in any way, an offer to buy or sell, a financial advice, an estimation, an expertise or a market valuation.

20.2 Lops TCG makes no representation or warranty, express or implied, as to the accuracy, completeness, timeliness, reliability or fitness for any particular purpose of the Price Data. Prices may be delayed, incomplete, inaccurate, or outdated. The User acknowledges that actual market prices may differ significantly from those displayed in the Service.

20.3 The Price Data is sourced from third parties whose own terms of use, accuracy and availability are beyond our control. We have no official partnership or commercial affiliation with Cardmarket, TCGPlayer, eBay, PSA or any other source. Data is obtained from publicly available sources or licensed third-party providers, used in compliance with their respective terms. Attribution and links to the source platforms are provided in the Service as a matter of good faith.

20.4 The User is solely responsible for any decision made based on the Price Data, including but not limited to the purchase, sale, exchange, valuation, insurance or grading of trading cards. Lops TCG shall not be held liable for any direct, indirect, financial or commercial loss arising from the use of the Price Data, in accordance with section 17.

20.5 Cardmarket, TCGPlayer, eBay, PSA and any other source name or logo displayed in the Service are trademarks or registered trademarks of their respective owners. Their mention is made for identification purposes only and does not imply any sponsorship, endorsement or partnership unless expressly stated.

20.6 The User shall not extract, scrape, copy, redistribute, resell or otherwise reuse the Price Data displayed in the Service for any commercial purpose or to build a competing service, in accordance with sections 8 and 15. The Price Data is provided only for the User's personal, non-commercial use within the Service.

20.7 Lops TCG reserves the right to remove, modify or suspend the display of any Price Data at any time, in particular upon request of the source provider or in case of change of its terms of use.
